These General Terms and Conditions ("Terms") govern the use of the Tolerly app and the associated websites and services provided by Creavo Solutions.
Tolerly is a digital application designed to provide users with information and automated assessments relating to foods, ingredients, intolerances, and allergens.
By purchasing or using Tolerly, you agree to these Terms to the extent that they apply to your use of the app and the services provided by us.
1. Scope
These General Terms and Conditions apply to the use of the Tolerly application ("Tolerly" or "App") and the associated websites and services provided by Creavo Solutions.
These Terms apply in particular to consumers who purchase or use Tolerly for private purposes.
Mandatory statutory consumer protection provisions remain unaffected by these Terms.

3. Subject Matter and Scope of Services
Tolerly is a digital application designed to help users assess foods and products with regard to selected intolerances, allergies, and other dietary parameters.
Depending on the available functionality, Tolerly may provide features including:
- searching for foods and products,
- scanning product barcodes,
- retrieving product information from external product databases,
- automated analysis of ingredients and product information,
- assessment of products with regard to user-selected intolerances or allergies.
The exact scope of functions may depend on the version of the App, the operating system used, the availability of external services, and technical circumstances.
4. Contract Formation and Purchase via App Stores
Tolerly is distributed through digital distribution platforms, in particular the Apple App Store and Google Play Store.
The purchase process, payment processing, and technical delivery of the App are carried out through the respective platform operator.
The terms and conditions of the respective platform operator may additionally apply to the use of the relevant store and its payment services.
The legal relationship concerning payment processing is therefore also subject to the applicable terms and policies of the respective App Store.
The statutory rights of consumers remain unaffected.
5. Price, One-Time Purchase and No Subscriptions
Tolerly is offered as a one-time purchase unless expressly stated otherwise at the time of purchase.
There are no automatically renewing subscriptions associated with the standard purchase of Tolerly.
The applicable purchase price is displayed to you by the respective App Store before the purchase is completed.
Payment is processed by the respective platform operator.
6. Technical Requirements
To use Tolerly, you need a compatible smartphone or other supported device and a compatible version of the operating system.
Certain functions require an active internet connection. This applies in particular to functions that require communication with Tolerly's servers.
The availability and functionality of individual features may also depend on the technical capabilities of your device, operating system, network connection, and third-party services.
7. AI-Assisted Analysis and Product Information
Tolerly uses automated technologies and artificial intelligence to analyze foods, ingredients, and product information.
The results are generated on the basis of available product data, ingredient information, the parameters selected by you, and automated processing.
AI-generated analysis results may be incomplete, inaccurate, outdated, or incorrect.
Product information may originate from external data sources and may contain errors, omissions, outdated information, or inconsistencies.
Tolerly does not guarantee that every product, ingredient, allergen, or intolerance will be identified correctly or completely.
The technical processing of requests may involve external service providers, including providers of product databases and AI services.

8. Medical Disclaimer and User Responsibility
Tolerly is an informational and technical assistance tool. It is not a medical device, medical diagnosis system, medical treatment, or substitute for professional medical or nutritional advice.
The analysis results provided by Tolerly must not be understood as a medical diagnosis or as a recommendation to consume or avoid a particular food for medical reasons.
If you have a known or severe allergy, intolerance, or other medical condition, you must not rely solely on a Tolerly analysis when deciding whether to consume a product.
In particular, you should always check the current information on the product packaging and, where appropriate, obtain information directly from the manufacturer or qualified medical professionals.
This is particularly important where consuming an incorrect product could result in serious or life-threatening health consequences.
You are responsible for making the final decision regarding the consumption of a food or product.
9. Availability and Technical Limitations
We strive to make Tolerly available as reliably as possible. However, continuous and uninterrupted availability cannot be guaranteed.
Temporary restrictions or interruptions may occur due to:
- maintenance and updates,
- technical failures,
- server or network problems,
- cyberattacks or other security incidents,
- failures or changes affecting third-party services,
- circumstances outside our reasonable control.
In particular, individual analysis functions may temporarily be unavailable if required external services cannot be reached.
Mandatory statutory rights regarding the availability and contractual conformity of digital products remain unaffected.
10. Updates and Maintenance
We may provide updates and technical improvements for Tolerly.
Updates may contain, among other things:
- bug fixes,
- security improvements,
- technical improvements,
- compatibility improvements,
- performance improvements,
- new or modified functions.
Where required by applicable law, we will provide the updates necessary to maintain the contractual conformity and security of the digital product and inform you appropriately about such updates.
You are responsible for installing updates made available to you within a reasonable period, unless the applicable law provides otherwise.
11. Changes to the App
We continuously develop Tolerly and may modify individual functions, the user interface, technical components, or the underlying infrastructure.
Changes may be necessary, for example, due to technical developments, security requirements, legal requirements, changes to external services, or improvements to the App.
Where applicable law requires specific conditions for changes to digital products, these conditions will be observed.
In particular, changes that materially impair access to or usability of the App are subject to the applicable statutory consumer rights.
12. Right of Use
Upon a valid purchase, you receive a personal, non-exclusive, non-transferable right to use Tolerly on compatible devices in accordance with these Terms and the applicable rules of the respective App Store.
The right of use is intended for personal use only and does not permit you to:
- reproduce, distribute, or commercially exploit the App outside the permitted scope,
- make the App available to unauthorized third parties,
- reverse engineer, decompile, or otherwise attempt to obtain the source code, except to the extent expressly permitted by mandatory law,
- circumvent technical protection measures,
- use the App for unlawful purposes.
Mandatory statutory rights remain unaffected.
13. Statutory Warranty and Defect Rights
The statutory rights relating to defects in digital products apply to Tolerly.
If Tolerly does not comply with the applicable contractual requirements, you may have statutory rights, including the right to have the digital product brought into conformity, to a reduction of the price, or to terminate the contract, depending on the statutory requirements.
Nothing in these Terms excludes or restricts mandatory statutory consumer rights.
14. Liability and Disclaimer
14.1 Limitations of Automated Analysis
Tolerly provides a technical information and analysis tool. The results provided by Tolerly are generated in part through automated processes and the use of artificial intelligence.
Despite careful development and appropriate technical measures, the analysis results may contain errors, inaccuracies, incomplete information, or outdated information. This applies in particular to the identification of ingredients, allergens, intolerances, and other food-related properties of products.
Tolerly therefore cannot guarantee that a food or product will always be assessed completely and correctly with regard to all relevant allergens, intolerances, or other properties.
14.2 Not a Sole Basis for Decisions Where Health Risks Are Involved
Tolerly is not suitable as the sole basis for deciding whether to consume a food or product where an allergy, intolerance, or other health risk is involved.
In particular, if you have a known or severe allergy where consumption of an unsuitable food may result in serious or life-threatening health consequences, you must not rely solely on the analysis results provided by Tolerly.
In such cases, always check the current and complete information provided on the product packaging, including the manufacturer's ingredient and allergen information.
Where necessary, you should also contact the product manufacturer or consult an appropriately qualified medical or nutritional professional.
The final decision as to whether to consume a food or product remains your own responsibility.
14.3 Statutory Liability
We shall be liable without limitation for damages arising from injury to life, body, or health where such damages result from an intentional or negligent breach of duty by us or by our legal representatives or vicarious agents.
We shall also be liable without limitation for damages caused by intent or gross negligence.
In the event of a slightly negligent breach of material contractual obligations (cardinal obligations), our liability shall be limited to the foreseeable and typically occurring damage.
To the extent permitted by law, liability for slightly negligent breaches of obligations other than material contractual obligations is excluded.
The above limitations of liability shall not apply where mandatory statutory liability applies. In particular, no liability for injury to life, body, or health, or for intentional or grossly negligent conduct, is excluded or unlawfully limited.
The statutory rights of consumers remain unaffected.
15. Right of Withdrawal
15.1 Right of Withdrawal for Consumers
If you purchase Tolerly as a consumer, you generally have a statutory right of withdrawal. The withdrawal period is generally 14 days from the date on which the contract is concluded, unless a statutory exception applies.
For digital content that is not supplied on a physical data carrier, however, the right of withdrawal may expire prematurely under the statutory conditions.
15.2 Expiration of the Right of Withdrawal for Digital Content
If you expressly request that we begin performing the contract before the withdrawal period has expired, and you expressly confirm that you are aware that you will lose your right of withdrawal once performance of the contract begins, your right of withdrawal may expire when performance begins.
The relevant notices and declarations may be obtained as part of the purchase process through the respective app store.
15.3 Exercising the Right of Withdrawal
If you have a statutory right of withdrawal and wish to exercise it, you may notify us by means of an unequivocal statement informing us of your decision to withdraw from the contract.

15.4 Statutory Rights Remain Unaffected

The Privacy Policy explains which data is processed when using Tolerly, for what purposes, and what rights you have under applicable data protection law.
17. Intellectual Property
All rights in and to Tolerly, including software, source code, designs, graphics, logos, texts, interfaces, and other content, remain with Creavo Solutions or the respective rights holder.
Unless expressly permitted by these Terms or applicable mandatory law, no rights to reproduce, distribute, modify, publish, or otherwise exploit such content are granted.
Product information and data obtained from third-party sources may be subject to the rights and licenses of the respective providers.

20. Final Provisions
The law of the Federal Republic of Germany applies, subject to mandatory consumer protection provisions of the country in which the consumer has their habitual residence.
If individual provisions of these Terms are or become invalid, the validity of the remaining provisions remains unaffected to the extent permitted by law.
Mandatory statutory provisions, in particular consumer protection provisions, take precedence over conflicting provisions of these Terms.
21. Changes to These Terms
We may amend these Terms where this is necessary due to changes in legal requirements, the services offered, technical developments, or other circumstances that require an adjustment of the contractual framework.
Changes will not unlawfully restrict your statutory rights.
Where applicable law requires your consent to a change, we will obtain such consent in the legally required manner.
